1. Introduction

We reserve the right to update these Terms at any time. Continued use of services constitutes acceptance of any revised Terms.

2. Services

Nexus Web Services provides hosting and related internet services including but not limited to:

  • Shared hosting
  • VPS hosting
  • Dedicated servers
  • Cloud hosting
  • Domain registration
  • Email hosting
  • Website security services
  • Managed services
  • Technical support

We reserve the right to modify, upgrade, or discontinue services at any time without liability.

3. Account Registration

To use our services you must:

  • Provide accurate and complete information
  • Maintain the security of your account
  • Be responsible for all activity under your account
  • Notify us immediately of unauthorized access

You must be at least 18 years of age to use our services.

4. Payments and Billing

4.1 Fees

You agree to pay all fees associated with your selected services.

4.2 Payment Terms

Payments must be made in advance according to the billing cycle selected:

  • Monthly
  • Annually
  • Contract term

Failure to pay may result in:

  • Account suspension
  • Service termination
  • Removal of data

4.3 Renewals

Services automatically renew unless cancelled before the renewal date.

4.4 Refunds

Refunds may be offered at our discretion or according to any advertised money-back guarantee.

Domain registrations and third-party services are generally non-refundable.

5. Acceptable Use

You agree NOT to use our services for:

  • Illegal activities
  • Fraudulent activity
  • Distribution of malware
  • Spam or unsolicited email
  • Phishing websites
  • Copyright infringement
  • Hosting pirated software
  • Botnets or DDoS attacks
  • Unauthorized penetration testing
  • Cryptocurrency mining (unless permitted)
  • Content promoting violence or hate
  • Any activity that disrupts infrastructure

We reserve the right to suspend any account violating these rules.

6. Customer Responsibilities

Customers are fully responsible for:

  • All website content
  • Data backups
  • Website security
  • Software updates
  • Compliance with laws
  • Password security

Nexus Web Services is not responsible for lost data under any circumstances.

7. Backups and Data

We may provide backups as a courtesy only.

We do not guarantee:

  • Backup availability
  • Backup accuracy
  • Backup restoration

Customers must maintain their own independent backups.

8. Service Availability

We aim to provide 99.9% uptime but do not guarantee uninterrupted service.

Service interruptions may occur due to:

  • Maintenance
  • Hardware failures
  • Cyber attacks
  • Network failures
  • Force majeure events
  • Third-party outages

Scheduled maintenance may occur without notice when necessary.

9. Limitation of Liability

To the maximum extent permitted by law, Nexus Web Services shall not be liable for:

  • Loss of profits
  • Loss of business
  • Loss of data
  • Indirect damages
  • Consequential damages
  • Service interruptions
  • Third-party failures

Our maximum liability shall not exceed the total amount paid by the customer in the previous three (3) months.

Nothing in this agreement excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot legally be excluded

10. Intellectual Property

Customers retain ownership of their website content and data.

Nexus Web Services retains ownership of:

  • Systems
  • Infrastructure
  • Software
  • Tools
  • Branding
  • Documentation

Customers may not:

  • Reverse engineer our systems
  • Copy proprietary software
  • Resell services without permission
  • Attempt to access restricted systems

11. Third-Party Services

Some services rely on third-party providers.

We are not responsible for failures caused by:

  • Domain registries
  • Data centres
  • Payment providers
  • Software vendors
  • Network providers

Use of third-party services is at your own risk.

12. Suspension and Termination

We may suspend or terminate services immediately if:

  • Payment is overdue
  • Terms are violated
  • Illegal activity is detected
  • Security risks are identified
  • Abuse complaints are received
  • Infrastructure is threatened

Customers may cancel services through their account portal or written notice.

Upon termination:

  • Services stop immediately
  • Data may be deleted after 14 days
  • Recovery may not be possible

13. Indemnification

You agree to indemnify and hold harmless Nexus Web Services from any claims, damages, or legal costs resulting from:

  • Your use of services
  • Your content
  • Your violations of law
  • Your breach of these Terms

14. Security

We implement reasonable security measures but cannot guarantee absolute security.

Customers must:

  • Use strong passwords
  • Keep software updated
  • Protect login credentials
  • Maintain website security

We are not liable for breaches caused by customer negligence.

15. Data Protection

We comply with applicable UK data protection laws including:

  • UK GDPR
  • Data Protection Act 2018

Personal data is processed according to our Privacy Policy.

Customers are responsible for the legality of data they collect through their websites.

16. Force Majeure

We are not liable for failure to perform obligations due to events beyond our control including:

  • Natural disasters
  • War
  • Terrorism
  • Power failures
  • Internet outages
  • Government actions
  • Cyber attacks

17. Changes to Services or Pricing

We may change:

  • Service features
  • Pricing
  • Infrastructure
  • Software

We will attempt to provide reasonable notice where practical.

18. Governing Law

This Agreement shall be governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
